Abstract

"Non conformité partielle", partially incompatible - this is the decision of the Conseil Constitutionel on the unconstitutionality of the law against hate speech on the Internet (Décision n° 2020-801 DC du 18 juin 2020; Loi visant à lutter contre les contenus haineux sur internet), the French equivalent of the Network Enforcement Act. The wording is a slight understatement. Large parts of the law have been declared unconstitutional and this could also have consequences for the planned European Digital Services Act.
